Rationale for Judgment of Compliance:
Members of the Texas State Technical College (TSTC) governing board can be dismissed only for cause and by due process. The organization and control of the Texas State Technical College System is vested in a nine-member Board of Regents. The Board is composed of persons appointed by the Governor of Texas with the advice and consent of the Senate. As a duly appointed official confirmed by the Senate, the Senate would also be involved in removing an individual from an appointed position. Chapter 665.022-.028 of the Government Code [Ref 1] describes the process for impeachment and removal after impeachment of specific categories of individuals, including a "regent, trustee, or commissioner having control or management of a state institution or enterprise." The term of office for each Regent is six years.
The Education Code, Chapter 135 [Ref 2] and the Bylaws, Rules and Regulations [Ref 3] outline the method of selecting and removing Officers of the TSTC Board of Regents. A duly elected officer may only be removed by a three-fourths majority of the full membership of the Board of Regents.
